Spousal Sponsorship Canada

Spousal sponsorship Canada is a federal immigration program that lets Canadian citizens and permanent residents sponsor their spouse, common-law partner, or conjugal partner for permanent residence. If your partner lives abroad or is already in Canada, this program offers a legal pathway to reunite your family permanently. For full program details, visit the IRCC spousal sponsorship overview page.

Who Can Be Sponsored for Permanent Residence in Canada?

Your Spouse

Your legally married partner (opposite or same-gender) in a marriage that is legally recognized both in the country where it took place and in Canada. Religious ceremonies alone are not sufficient - the marriage must be legally registered.

Your Common-Law Partner

A person who has been living with you in a committed, conjugal relationship continuously for at least one year. This applies to both opposite and same-gender relationships and requires proof of cohabitation and commitment.

Your Conjugal Partner

A person living outside Canada who has been in a conjugal relationship with you for at least one year but cannot live together as a couple due to circumstances beyond your control (such as immigration barriers, religious restrictions, or sexual orientation persecution).

At Mirzoyan Immigration Services, we understand that every relationship is unique. We work with you to identify your relationship category and best sponsorship strategy for your specific situation and help you gather the strongest possible evidence to support your application.

Who Cannot Sponsor a Spouse in Canada

Some situations make you ineligible to sponsor. You cannot sponsor if:

  • You are currently being sponsored for permanent residence yourself.

  • You previously sponsored a spouse or partner, and that person is still subject to a sponsorship undertaking.

  • You have been convicted of a violent or sexual offence, or an offence against a family member.

  • You are in default on a previous sponsorship undertaking.

  • You are in default on a court-ordered support order, such as child support or alimony.

  • You are bankrupt and not yet discharged.

  • You are receiving social assistance for reasons other than a disability.

  • You were previously sponsored as a spouse or partner and became a permanent resident less than five years ago.

If any of these situations apply to you, speak with a licensed RCIC before assuming you cannot sponsor. Some disqualifiers have exceptions. Others are time-limited.

Understanding Your Options For Spousal Sponsorship Canada

Why Your Choice Matters

Once you submit your application, Immigration, Refugees and Citizenship Canada (IRCC) will not allow you to switch categories. If you choose incorrectly, you may need to withdraw your application and start over, losing valuable time and money. At Mirzoyan Immigration Services, we ensure you make the right choice from day one.

Outland Application

(Family Class)

Best for: Couples where the sponsored partner lives outside Canada or prefers to maintain that option

Key Benefits:

  • Sponsor can live in Canada or abroad (if Canadian citizen)

  • Can sponsor conjugal partners

  • Right to appeal if application is refused

  • Sponsored partner can apply for visitor visa study permit, or an open work permit.

  • No risk if sponsored partner travels outside Canada

Considerations:

  • An open work permit is not automatic, but some Family Class applicants who are physically in Canada may qualify during processing.

  • Processing times can vary by stream and location, and should be checked against IRCC’s current processing estimates.

Inland Application

(Spouse or Common-Law Partner in Canada Class)

Best for: Couples already living together in Canada who want work authorization during processing

Key Benefits:

  • Sponsored partner can apply for open work permit

  • Often faster processing for certain countries

  • Both partners remain in Canada throughout process

Considerations:

  • Sponsor must live in Canada

  • Cannot sponsor conjugal partners

  • No right to appeal if refused

  • Risk to application if sponsored partner leaves Canada

  • Limited travel options during processing

The Spousal Sponsorship Process - Your Roadmap to Success

Step 1: Strategic Planning and Document Gathering

The decisions you make before submitting your application shape everything that follows. Choosing the wrong application category means starting over. Missing a required document triggers a procedural refusal. Starting with a clear plan protects your timeline and your money.

Our immigration consultants work with you to:

  • Determine the optimal application category for your situation

  • Access country-specific document checklists from IRCC

  • Create a comprehensive document collection strategy

  • Establish a PR Portal account for online submission

  • Develop a timeline that aligns with your family's needs

Step 2: Application Preparation and Relationship Documentation

IRCC assesses every spousal sponsorship application for relationship genuineness. The documents you submit must tell a clear, consistent story about your relationship. Gaps in documentation, inconsistencies between forms, or thin relationship evidence are the most common reasons applications are refused.

We assist you in:

  • Completing all required immigration forms with accuracy

  • Gathering compelling proof of relationship authenticity

  • Collecting identification documents (passports, birth certificates)

  • Assembling financial documentation (employment letters, income proof)

  • Preparing detailed letters of explanation

  • Organizing photos, communication logs, and relationship timeline

  • Securing supporting affidavits from family and friends

Step 3: Quality Review and Submission

A single missing signature or an incorrectly answered question can result in your application being returned without processing. IRCC does not contact you to fix errors before making that decision. A thorough pre-submission review is not optional, it is the last line of defence before your application leaves your hands.

Before submission, Mirzoyan Immigration Services:

  • Conducts comprehensive application review

  • Verifies all forms are accurately completed and signed

  • Ensures all supporting documents meet IRCC requirements

  • Double-checks country-specific checklist compliance

  • Submits your complete application through the PR Portal

Step 4: Application Processing and Communication

Once IRCC receives your application, processing begins. IRCC may contact you at any point for additional documents, clarification, or an interview. Response deadlines are strict. Missing a deadline or submitting an incomplete response can result in a refusal without further notice.

During processing, we:

  • Monitor your application status

  • Respond to IRCC requests for additional information

  • Prepare you for potential interviews

  • Keep you informed of processing updates

  • Assist with medical examinations and background checks

Step 5: Decision and Next Steps

If IRCC approves your application, your partner will receive confirmation of permanent residence and landing instructions. If IRCC refuses, you have options — but your options depend on which application category you used. Inland applicants do not have the right to appeal. Outland applicants can appeal to the Immigration Appeal Division. Understanding this distinction before you apply matters.

Upon receiving IRCC's decision, we:

  • Celebrate your success and guide you through landing procedures

  • If additional information is requested, respond promptly and strategically

  • In case of refusal, explore appeal options or reapplication strategies

  • Ensure your family reunification goals are achieved

Spousal Sponsorship Processing Times

Processing times for spousal sponsorship vary. They depend on your application type, your partner's country of residence, and current IRCC volumes. Inland applications (Spouse or Common-Law Partner in Canada Class) and Outland applications (Family Class) are processed on separate tracks. They do not have the same timelines. IRCC publishes current processing time estimates on its website. These estimates update regularly and reflect real application volumes. Check current spousal sponsorship processing times on the IRCC website.

Processing times do not include the time it takes to prepare and submit your application. A complete, well-organized application avoids delays caused by requests for missing documents.

Spousal Sponsorship Fees

Spousal sponsorship requires two types of fees. The first is IRCC's government application fee. The second is the fee you pay your immigration consultant for professional services.

Government fees are set by IRCC and paid directly to the government. They cover the sponsorship application and the permanent residence application. Your partner's biometrics fee is also paid separately to IRCC. Check the current IRCC government fees for spousal sponsorship.

Government fees are non-refundable in most circumstances. If your application is refused, IRCC does not return the processing fee.

Professional service fees are separate from government fees. Mirzoyan Immigration charges a flat professional fee for spousal sponsorship. You will receive a clear breakdown before any work begins. View our fee schedule.
